Mortgage Referral & Data Sharing Policy

1. Introduction and Service Overview

When you submit a Viewing Request for a property listed on the 4walls platform (operated by 4 WALLS AGENTS LTD, Company No: 13864769), you are given the option to speak with a mortgage expert.

By selecting the tick box “Find out if I could afford this home — speak to a mortgage expert”, you provide your explicit consent for us to share your personal and financial data with our third-party partner, the Mortgage Advice Bureau (MAB).

Important: This consent is collected separately from the general Privacy Policy and Terms & Conditions acceptance on the form. Ticking the mortgage referral box is entirely optional and independent of your viewing request.

This policy supplements our main Privacy Policy (4walls.io/privacy-policy), Terms of Service (4walls.io/terms), and Cookie Policy (4walls.io/cookie-policy). In the event of any conflict, this policy governs the specific processing described herein.

2. Who We Share Your Data With

Your information is transmitted to the Mortgage Advice Bureau network. The primary entities responsible for your data upon receipt are:

  • Mortgage Advice Bureau Limited (Company No: 03368205)

  • Mortgage Advice Bureau (Derby) Limited (Company No: 06003803), authorised and regulated by the Financial Conduct Authority (FCA)

  • Registered Office: Capital House, Pride Place, Pride Park, Derby, DE24 8QR

Once shared, MAB becomes an independent data controller of your information and will process it in accordance with their own privacy policy.

3. Personal Data Collected and Shared

To facilitate an accurate affordability appraisal, our automated systems will share the following data points from your Viewing Request form:

  • Contact Details: Your first name, last name, telephone number, and email address.

  • Property Interest: The specific development or listing address and the enquiry type (Sales or Rent).

  • Property Preferences: The type of property you are looking for (as selected on the form dropdown).

  • Financial Indicators: Your indicated ideal budget range (as selected via the budget slider, showing minimum and maximum values) and your intended timeframe for moving.

  • Additional Context: Any specific requests or information you provide in the additional comments field.

Note: We only share the data listed above. We do not share browsing behaviour, device information, or any other data not explicitly entered on the Viewing Request form.

4. Lawful Basis for Processing

We rely solely on your Explicit Consent to initiate this referral. Under the UK General Data Protection Regulation (UK-GDPR) and the Data Protection Act 2018:

  • Consent is Voluntary: You are under no legal or contractual obligation to use this service. The mortgage referral tick box is separate from, and independent of, the general Terms & Conditions acceptance required to submit a viewing request.

  • Consent is Specific and Unbundled: Your consent to share data with MAB is collected through a dedicated, clearly labelled tick box that serves no other purpose.

  • Withdrawal of Consent: You have the right to withdraw your consent at any time by contacting us at contact@4walls.io. Withdrawal will stop any further data sharing with MAB immediately but will not affect the lawfulness of sharing that occurred prior to withdrawal. If MAB has already received your data but has not yet made contact, we will notify MAB of your withdrawal request.

5. No Obligation and Anti-Conditional Selling

In accordance with The Property Ombudsman (TPO) Code of Practice and the 2026 Guidance on Conditional Selling, 4walls confirms that:

  • Your request to view a property or make an offer is not conditional on you speaking to a mortgage advisor.

  • Your ability to access 4walls property services remains entirely independent of your choice to use MAB’s advisory services.

  • No preferential treatment will be given to buyers who opt in to the mortgage referral service.

6. Transparency of Referral Fees

4walls is committed to the transparency mandates issued by National Trading Standards (NTSELAT).

  • Referral Benefit: If you choose to instruct MAB and subsequently complete a mortgage transaction, 4WALLS may receive a referral fee or commission.

  • Consumer Impact: This fee is a commercial arrangement between 4walls and MAB and does not result in any additional cost to you or affect the mortgage rates you are offered.

7. Automated Decision-Making and Contact Process

We use an automated algorithm to route your enquiry to the most appropriate MAB advisor based on your location and property interest. The process is as follows:

  • Instant Confirmation: You will receive an immediate email confirming that your details have been shared, including the identity and contact details of the specific MAB advisor assigned to you.

  • Advisor Contact: A qualified mortgage advisor will contact you via telephone or email to conduct a human-led affordability appraisal.

  • Booking Option: The confirmation email will also include the option to book a convenient time for your mortgage appraisal at a time that suits you.

Note: While the initial routing is automated, all mortgage advice and affordability assessments are conducted by qualified human advisors. You have the right to request human review of the advisor allocation by contacting us at contact@4walls.io.

8. Data Security and Retention

All data is transferred using secure, encrypted APIs (SSL/TLS). Our data retention periods are as follows:

  • 4walls: We retain a record of your referral for 24 months for audit and service improvement purposes, after which it is securely deleted.

  • MAB: MAB will retain your data in line with FCA regulatory requirements. Successful mortgage application files are generally held for a minimum of 6 years.

9. Your Rights

Under the UK-GDPR, you have the right to:

  • Access the personal data we hold about you.

  • Rectify any inaccurate or incomplete data.

  • Erase your personal data (subject to legal retention requirements).

  • Restrict or object to processing in certain circumstances.

  • Data portability — receive your data in a structured, commonly used format.

  • Withdraw consent at any time without affecting your access to 4walls services.

  • Submitting the form without ticking this box should proceed normally — the viewing request is unaffected.
