“Mobile application” means 4walls mobile app or application on Android and IOS devices.

Therefore, each time you log onto this website, you should check for any such changes.
We cannot accept any responsibility for any damages, losses, or viruses arising directly or indirectly from the use of this website.

2. Limitation of Liability and Indemnity
2.1. We do not exclude or limit in any way liability for death or personal injury caused by our negligence or the negligence of our Associates, fraud or fraudulent misrepresentation; or breach of any terms implied by the Supply of Goods and Services Act 1982.
2.2. If we fail to comply with these terms and conditions, our liability to you shall not exceed the price you have paid for the Services (including the package you have purchased and/or any add-ons). Our liability shall not in any event include business losses such as loss of data, loss of profits, loss of contracts or business interruption.
2.3. We do not accept any responsibility for any loss or damage caused by a prospective buyer visiting the Property.
2.4. You agree that it is your responsibility to ensure the safety of any prospective buyer or tenant visiting your Property, and we do not accept any liability in this respect.
3. Intellectual Property
The copyright and all other intellectual property rights in the 4walls website and mobile application, including text, graphics, photos, code, files, and links, belong to 4walls. You may not reproduce, transmit, or store any part of the website or mobile application without prior written consent from 4walls, except for personal, private, and non-commercial use
4. Interruptions and Omissions in This Service
While we take every care to ensure that the standard of this website and 4walls mobile application remains high, the Internet is not always a stable medium, and errors, omissions, interruptions of service and delays may occur at any time. As a result, we do not accept any ongoing obligation or responsibility to operate this website (or any particular part of it).

The 4walls website and mobile application may contain links to websites and resources operated and provided by third parties, any such links are provided for your convenience and information only. 4walls has no control over their individual content and 4walls makes no representations, warranties or guarantees, whether express or implied as to the accuracy or completeness of any of the information appearing in relation to any linked websites nor as to the suitability or quality of any of products or services offered.

We cannot provide “services” outside of England; this includes Scotland, Ireland, and Wales.
7. Description of the Property
7.1. It is your legal responsibility to disclose any information you are aware of that relates to the Property in a clear, intelligible and timely manner and you agree to comply with this responsibility. You will provide information that is accurate and not misleading and you must not omit to disclose anything material that may impact the average consumer's transactional decision in relation to the Property. If the property is a leasehold property, you must provide details of service charges, ground rent, the number of years remaining on the lease, and any special conditions relating to the lease.
7.2. You acknowledge and agree that it is your responsibility to check your Property listing in its totality and notify us of any incorrect or missing information prior to the Property being listed on the market. If at any time you become aware of any such incorrect or missing information while the Property is listed on the market, you must notify us immediately.
7.3. If you feel that any marketing material promoting the Property is not accurate or is misleading, you must contact us immediately. We will review the relevant material as soon as is practicable and take such action as is necessary to amend the material. You acknowledge that material promoting the Property is subject to change at any time.
7.4. If we are notified or made aware of information or material provided by you that infringes a third party's intellectual Property rights, we have the right to remove the Property from Our Website and partner sites immediately.
8. Marketing
We will advertise the Property for sale on Our Site and Partner Sites that we consider to be for securing interest in the Property from prospective Purchasers for the 14 week duration of the Marketing Period. We reserve the right to withdraw the advertisement and marketing of the Property from Our Site and/or Partner Sites at our absolute discretion.
Third party websites, such as partner sites, are subject to change and we do not guarantee the continued presence of the Property on any individual website.
9. Market Appraisal
4walls agent’s will provide a guide price for marketing the Property for sale. The guide price is based on 4walls experience and data obtained from various sources, including but not limited to Partner Sites and the Land Registry. Ultimately, it will be your decision (as a Seller) to decide on the Marketing Price to include in the Property Advert. You will be able to amend the Marketing Price by notifying us at any time during the Marketing Period.
You agree and acknowledge that the guide price provided by the 4walls agent’s during or following the Market Appraisal is not a valuation of the Property.
10. Reviews
After each viewing, the buyer will have the opportunity to privately give feedback on the property they have seen. Your feedback must be accurate and may not contain any discriminatory, offensive, defamatory, or other language. Reviews are not verified by 4walls for accuracy and may be incorrect or misleading.
11. Offers
You will be able to view all offers in 4walls and communicate directly with the prospective Purchaser. If you would like assistance in negotiating any offers, you should email contact@4walls.io as this is included in the services.
Upon agreeing to the sale of the Property with any Purchaser, you must promptly provide us with the contact details of your instructed conveyancer or solicitor and your mortgage provider. If your instructed conveyancer, solicitor or mortgage provider changes before Completion, you must promptly provide us with the updated contact details of you or your buyer's instructed conveyancer or solicitor.
Once an offer for the sale of the Property has been accepted and the Memorandum of Sale has been signed by both parties, we will automatically forward your details and the details of the prospective Purchaser to the conveyancer or solicitor whom you have instructed.
The responsibility for ensuring all parties are aware of any changes or developments to the property lies with you.
Your property marketing period pauses or stops when an offer has been accepted. If your Property does not complete after this period, we will resume marketing it at your request for the remainder of the Marketing Period.
We own the photos that we take of your Property.
If you wish to add your own images to your listing, the photograph must be;
owned by you or you have permission to use it;
of the Property;
representative of the Property's current condition.
You may not use your listing with us to gain interest in other properties not listed with us, and you may not upload any corporate or other logos, images, or brand identifiers to the Property description, or include the same in any image you submit to us. We can cancel your Agreement with us if we reasonably believe you are doing this.
You are not permitted to pass, for their use or use on your behalf, any login details we supply to you as part of the Services, to any person who acts in a professional capacity, including but not limited to any estate agent or letting agent.
12. Right to Cancel
You have the right to cancel this Agreement within 14 days of accepting these terms and conditions, in accordance with the Consumer Contracts Regulations 2013, without giving any reason and will be afforded the protections set out in this clause and clause 11 below. Services that have already begun, with your consent, within the 14 day period, are excluded from this provision.
To exercise the right to cancel, you must inform us by either calling us by emailing us contact@4walls.io
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
If you cancel this Agreement within 14 days of accepting these terms and conditions, we will reimburse you for all payments received from you less a reasonable sum for any costs incurred in supplying any Products to you prior to our receipt of your request to cancel the Agreement.
We will make the reimbursement without undue delay, and not later than 28 days after the day on which we are informed about your decision to cancel this Agreement.
13. Prohibited uses
You may use our site and mobile application only for lawful purposes. You may not use our site or mobile application:
In any way that breaches any applicable local, national, or international law or regulation.
In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
To send, knowingly receive, upload, download, use, or re-use any material that does not comply with our content standards.
To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
To knowingly transmit, send, or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programmes or similar computer code designed to adversely affect the operation of any computer software or hardware.
14. Interactive Services
4walls provides interactive services on our site and/or links to social media platforms, including, without limitation:
Messaging systems.
Blogs.
Email correspondants
Social media platforms, including (but not limited to) Twitter, Tik Tok and Instagram.
4walls will do its best to assess any possible risks for users (and, in particular, for children) from third parties when they use any interactive service provided on our site and mobile application, and 4walls will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, 4walls is under no obligation to oversee, monitor, or moderate any interactive service 4walls provides on its site, and 4walls expressly excludes its liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.
The use of any of our interactive services by a minor is not allowed, users have to be 16 years of age or older.
4walls reserves the right to monitor any conversations that take place on the 4walls application on both iOS and Android for the purpose of making sure conversations between buyer and seller are fit and proper and fall within the conditions and terms of service set out by 4walls.
15. Information on the 4walls site and applications
The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.
Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.
16. Content Standards
These content standards apply to any and all material that you contribute to our site (contributions), and to any interactive services associated with it. Including mobile applications.
You must comply with the spirit and letter of the following standards. The standards apply to each part of any contribution as well as to its whole.
Contributions that violate these content standards may be removed, and users who repeatedly violate the standards may have their access to the interactive services restricted or terminated
Contributions must:

Be likely to deceive any person.
Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
Promote any illegal activity.
Be threatening, abusive, or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.
Be likely to harass, upset, embarrass, alarm or annoy any other person.
Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
Give the impression that they emanate from 4walls Agents LTD
Advocate, promote or assist any unlawful act, such as (by way of example only) copyright infringement or computer misuse.
17. Personal Data
Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using the 4walls website and/or applications (IOS and/or Android) you consent to such processing and warrant that all data provided by you is accurate.
