1. About us and these terms

4WALLS Agents Ltd (“4WALLS”, “we”, “us”) is registered in England and Wales (Company No. 13864769), at 5th Floor, 167–169 Great Portland Street, London W1W 5PF. These Terms of Use govern your use of our website www.4walls.io and any related buyer-facing services we provide (together, the “Service”).

By using the Service or creating an account, you accept these Terms of Use. If you do not accept them, please do not use the Service.

How we handle your personal data is set out in our Privacy Policy, and how we use cookies is set out in our Cookie Policy.

2. What 4WALLS does

4WALLS is a property introducer. We market new-build developments on behalf of property developers, and connect interested buyers with the developer of the development they wish to view or buy.

We are not the seller of any property. We do not own or hold any interest in the developments listed on our Service. The developer is the seller, sets the price, conducts viewings, handles offers, reservation forms, anti-money-laundering checks and the memorandum of sale, and is responsible for the property itself.

Our service is free to use for buyers. You will never pay 4WALLS a fee for browsing the Service, enquiring about a property, booking a viewing or being introduced to a developer.

3. Your account

To enquire about a property or book a viewing you may need to create an account. When you create an account you must give accurate information, keep your login details confidential, and not let anyone else use your account.

Through your account you can browse developments, submit enquiries, and book viewings. You can close your account at any time by emailing contact@4walls.io. We may suspend or close your account if you breach these Terms of Use.

Where the law gives you a right to cancel a contract formed at a distance, you have a 14-day cancellation period from creating your account. Because the Service is free to buyers, no refund is needed; you can simply ask us to close your account.

4. Property information on the Service

Photography and video on the Service are produced by 4WALLS. Written descriptions are prepared by 4WALLS using information supplied to us by the developer. Floor plans, prices, dimensions, specifications, availability and all other underlying information about a development come directly from the developer. We do not independently verify the underlying information supplied to us by the developer.

Information about a property may change at any time without notice, including price and availability. You should confirm any detail that matters to you directly with the developer before making a decision to view, reserve or purchase.

Photography and video produced by us is intended to give you a feel for a development. It is illustrative and not a substitute for visiting the property in person.

5. Enquiries and viewings

When you enquire or book a viewing through the Service, we share your details with the relevant developer in line with our Privacy Policy. The developer (not 4WALLS) will conduct the viewing and is responsible for the conduct of the viewing, the safety of attendees and the property itself.

We are not responsible for the property you view, the suitability of the property for your needs, the conduct of the developer or its representatives, or any loss, damage or injury arising from a viewing or a purchase.

6. Communications and mortgage referral

By using the Service and submitting an enquiry you may consent to being contacted by us by telephone, email, WhatsApp and SMS about the property you enquired about, similar properties and our marketing promotions. You can opt out at any time as described in the Privacy Policy.

If you opt in to the mortgage referral service operated with the Mortgage Advice Bureau, we may receive a referral fee from MAB if your referral results in a completed mortgage transaction. This does not cost you anything and does not affect the rates you are offered. Full detail is in our Privacy Policy.

7. Intellectual property

All content on the Service — including photographs, videos, written descriptions we produce, software, brand, logos and design — is owned by 4WALLS or licensed to us. You may view content on the Service for your personal, non-commercial use. You may not copy, download, reproduce, republish, redistribute or use any content commercially without our prior written consent.

In particular, photography and video produced by 4WALLS may not be downloaded, screen-recorded, re-uploaded to other platforms, or used in any commercial or marketing context.

8. Acceptable use

You agree to use the Service lawfully and respectfully. You must not:

• Submit false, misleading or another person's personal information

• Use the Service to harass, defame, abuse, threaten or send unwanted material to anyone

• Behave abusively or aggressively toward our team, our sales team, developers, or other users — whether in writing, on the phone, on WhatsApp or in person

• Upload or transmit any virus, malicious code or harmful content

• Attempt to access, scrape, copy or interfere with any part of the Service you are not authorised to use

• Use the Service for any unlawful purpose or in breach of any applicable law or regulation

We may suspend or terminate your account immediately if you breach this section, and we may report serious misconduct to the relevant authorities.

9. Links and third-party services

The Service may include links to developer websites, mortgage providers or other third-party sites. We provide these for convenience only. We have no control over their content, products or practices, and we are not responsible for them. You use third-party services at your own risk and on their terms.

10. Availability of the Service

We try to keep the Service available and up to date, but we do not guarantee that it will always be available, error-free, or that the information shown will always be accurate. We may add, change, suspend or withdraw all or part of the Service at any time.

11. Our liability to you

Nothing in these Terms of Use excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or breach of your statutory rights as a consumer.

Subject to the previous paragraph, because 4WALLS is an introducer and the Service is free to buyers:

• We are not liable for the property itself, for the developer's conduct, for what happens at a viewing, for the accuracy of developer-supplied information, or for any decision you make to view, reserve or purchase a property.

• We are not liable for business losses (including loss of profits, opportunity, contracts, anticipated savings, or data), or for any loss that was not reasonably foreseeable when you started using the Service.

• Our total liability to you in any 12-month period in connection with the Service is limited to £100.

12. Changes to these terms

We may update these Terms of Use from time to time, for example to reflect changes in the Service or in the law. The “Last updated” date at the top shows when they were last changed. If you continue to use the Service after we update these terms, you accept the updated version.

13. Complaints and redress

If you have a complaint about the Service, please email us first at contact@4walls.io so we can try to resolve it. 4WALLS is a member of The Property Ombudsman scheme and follows the Code of Practice for Residential Estate Agents (see tpos.co.uk). If we cannot resolve your complaint, you may refer it to The Property Ombudsman.

14. Governing law

These Terms of Use, and any dispute arising out of them or your use of the Service, are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the United Kingdom, you may also be able to bring proceedings in your local courts.
